| Booking Conditions 1. Authority to Sign The Party leader signs the booking form and agrees the Terms & Conditions on behalf of all persons in the party. The party leader must be 18 years old or over, must be a member of the party intending to occupy the apartment for the duration of the holiday and agrees to take responsibility for the party during their stay . 2. Duration and Times of Rental Apartments can be booked for a maximum of 4 weeks and commence at 4pm on the first day and end at 10am on the day of departure. The period booked will be clearly stated on the Booking Confirmation provided to the Client and cannot be exceeded without the owners written approval. The Client will be liable for any cost of whatever nature incurred because of an unauthorised extension. 3. Deposit A deposit of 30% of the cost of the holiday is required if the apartment is booked more than 8 weeks before the start of the holiday. If the booking is made less than 8 weeks before the start of the holiday, then the total fee is payable. 4. Method of Payment All payments may be made by credit card, debit card or cheque. Payments for holidays booked less than 2 weeks before the date of the start of the holiday can only be accepted by credit card, debit card or bank transfer. Post dated cheques will not be accepted. 5. Final Payments The price for the Holiday shall be the rent for the apartment as set out on the U K Leisure Breaks website, at the time of the booking, unless otherwise agreed by the Owners in writing. Once the booking is received and accepted by the Owners, the Client is liable for payment of the balance due 8 weeks before the start of the rental. If payment is not received on or before the Due Date, this shall be construed as a cancellation of the contract by the Client and the Client will lose their booking and forfeit their deposit. The Owners do not undertake any responsibility for sending reminders of the Due Date. The Balance Due and the Due Date will be set out on the Booking Confirmation; Clients should read the confirmation very carefully and notify the owners of any discrepancies immediately The Owners strongly recommend Clients take out Cancellation Insurance. 6. Payment of Damages Clients are required to supply credit or debit card details with their final payment, to cover any loss or damage to the property and its contents and to cover any additional cleaning required as a result of their use of the property. If any payment is required to cover missing items, damages or extra cleaning, it will be taken within 7 days from the date of departure and Clients will be notified in writing, with full details of the expenses incurred. No charge will be taken unless damages occur, items are missing or extra cleaning is required. All credit and debit card details are held securely and will be destroyed in line with the Data Protection Act 1998 7. 8. Cancellation Any cancellation made by the Client for whatever reason shall be made in writing and sent to the owners: BSP Assets Ltd., Unit 2, Old Station Road, Ventnor, Isle of Wight PO38 1DX For a cancellation more than 8 weeks before start of holiday, the Client, shall forfeit the initial deposit. For a cancellation 8 weeks or less before start of holiday the Client shall forfeit the total cost.
On receipt of notice of cancellation, the owners will seek to re-let the property for the period of booking. If the Owners succeed in re-letting the property for the whole period they shall refund all the monies paid less an administrative charge of 25% per booking. If the owners only succeed in re-letting the property for part of the period booked it shall refund an amount equal to the money paid less (1) the rental for the period which is not re-let and (2) and administrative charge of 25%. If the Owners are unable to re-let the property at all then all monies paid by the client shall be forfeit to the Owners. The Owners strongly recommend Clients take out Cancellation Insurance 9. Price changes The Owners reserve the right to amend prices quoted on the Web site due to errors or omissions. But such changes shall be notified to the client as soon as possible and the Client shall be able to cancel the booking if the amended price is significantly higher than the original price quoted. 10. Changes of Date The Owners may consider a request from a client to change the dates of the booking after Booking Confirmation has been issued, providing that: (a) the date is available; (b) the request is received more than 8 weeks before the start of the booking; and (c) the client pays an administration fee of £30. 11. Period of Hire Rentals commence, unless otherwise notified at 4.00 pm on the day of arrival and terminate at 10.00 am on the day of departure. 12. Use of Property The number of persons occupying the property must not be more than the maximum specified unless agreed in writing. The property will be used for personal and domestic purposes only. The property shall not be used for any commercial purposes without the written consent of the Owners. The Owners reserve the right to refuse entry to the entire party if these conditions are not observed. The Client has the right to occupy the property for a holiday only (within the meaning of Schedule 1, Paragraph 9 of the Housing Act 1988). No smoking is permitted in any part of the building. 13. Dogs Dogs are discretionary on application and at a charge of £5.00 per night per dog (£25 per dog per week). The maximum number of dogs allowed in any apartment is 2. Dogs are not allowed in the Leisure suite, bedrooms or on any of the apartment furniture. Dog owners are responsible for cleaning up after their dogs and must leave no trace of their dog(s) having been at the property. A Dog waste bin is located in the bin store. Dogs are not to be left unattended in apartments unless owners are on the premises as this can result in considerable damage to the property & distress to the dog. It is the client’s responsibility to ensure that their dog(s) do not disturb those in adjoining properties or nearby and that they are fully responsible for every aspect of their dog’s behaviour. The Owners & their agents cannot accept any responsibility whatsoever for the dog(s) safety. 14. Care of the Property Clients shall take all reasonable and proper care of the property and its contents and leave them in the same state of repair and condition at the end of the rental period as at the beginning. The Client agrees to make a full disclosure of all damage caused to the property during the let and to inform the owners accordingly before leaving and also to report any items that are not in working order. 15. Breakages or Damage The Client is legally bound to reimburse the Owners for replacement, repair or extra cleaning costs on demand. 16. Right of Entry The Owners and their servants or agents shall be allowed the right of entry to the property at all reasonable times for purposes of inspection or to carry out any necessary repairs or maintenance. 17. Complaints Should there be any cause for complaint during the occupation of the property the Owners must be notified promptly and in the case of serious problems, it must be confirmed in writing. 18. Owners Liability The owners accept no liability for any accidental damage or loss to Clients possessions, injury expense or inconvenience which may be suffered, incurred, arise out of, or in any way connected with, occupation or the rental of St Martin’s apartments. No terms of the contract are enforceable under the contracts (Rights of Third Parties Act 1999) by a person who is not party to the contract. If the property which the Client has booked becomes unavailable or unusable for any reason prior to the holiday start, then the Owners obligation will be to reimburse the Client for any monies paid. Nothing in these conditions excludes or limits the liability of the Owners: for death or personal injury caused by the Owners negligence; for any matter which it would be illegal for the Owners to exclude or attempt to exclude their liability. 19. Swimming Pool – (this is a Private pool), Gym & Sauna Children must be supervised at all times by a competent adult. You must not enter the pool unless you are a competent swimmer, you must not dive into the pool, you must check the depth of the water before entering, you must not use the pool after consuming alcohol, you must not allow any dogs into the pool, and you must act responsibly at all times when using the pool. There is no lifeguard. The door to the pool area has a security lock and the pool has an adult operated alarm sensor. No glass or crockery is permitted in the pool area. NB: USE OF POOL IS RESTRICTED TO CLIENTS ONLY – As this is a private pool, Visitors/ Guests are strictly prohibited from using the pool due to cover. 20. Games Room Children under the age of 9 years must be supervised at all times, by an older child or adult. No food or drink may be consumed in the games room. The Client is legally bound to reimburse the Owners for replacement or repair to any equipment. 21. Parking Each Apartment has one allocated parking space. A limited number of additional spaces are available on a first come, first served basis. All vehicles are parked at their owner’s risk. 22. Warranties The Owners do not warrant and are not responsible for the accuracy of any verbal information given or statements made by its servants or agents. 23. Web Site Descriptions If the Owners are aware of any material changes to the Web site at the time of the Clients booking, then they shall endeavour to inform the Client of these changes. Some of the information on the Web site relates to matters beyond St Martin’s Apartments such as attractions, shops, restaurants and public houses. Closure of such premises and other changes are outside the Owners control. 24. Internet Access Wireless broadband access is provided free of charge. Clients will need to bring their own laptop or other wireless enabled devices to use the service as no computer is available at the apartment. 25. Linen All bed linen & towels are provided. Clients are expected to bring their own pool and beach towels. 26. Utilities All household utility costs are included in the price. 27. Breach of Contract If there is a breach of any of these conditions by the Client or any of their party, the Owners or their servants or agents reserve the right to re-enter the property and end the Holiday and ask the Client and their party to leave. If there is a breach of any of these conditions by the Owners, then the Clients have the right to end the Holiday and leave. Ending the Holiday by either the Owner or the Client does not affect that party's other rights and remedies. 28. Governing Law and Jurisdiction Any dispute will be governed by the non-exclusive law and jurisdiction of the English or Scottish Courts. 29. Validity Clause In the event that a court finds that a condition in these Booking Conditions is illegal or void, the illegal or void provision will be severed from the remainder of the Booking Conditions, which will continue to be valid and have full force and effect. 30. Noise The client agrees not to act in any way that would cause disturbance to other clients / residents of St Martins and the neighbouring dwellings. 31. Discrepancies In case of a discrepancy between these Booking Conditions and any other content of the property's Web site, these Conditions shall prevail, but this shall not limit the Owners liability for failure to supply the accommodation as described on the Web site. The Owners reserve the right to replace any of the furniture, fixtures and fittings shown in the images on the website. Updated images will be made as soon as practically possible. Any changes will be of a similar nature and quality level as previous images show. 32. Contract The Contract is between the Owners of St Martin’s Luxury Apartments and customers booking the holiday letting (the Client). The Contract will be entered into when the Owners issue the Booking Confirmation form and will be subject to all these Booking Conditions. The Client should check the Booking Confirmation form carefully. |
